This Privacy Policy explains how we collect, use, and protect information when you use our AI-powered lead capture platform and related services ("Service"), including when you interact with our SMS messaging system, chat widget, or owner dashboard.
By using LeadTap, you agree to the collection and use of information in accordance with this policy.

- Name, phone number, and email address when you contact a LeadTap-powered business
- Service inquiries and requests submitted through our chat widget or SMS system
- Business information provided during account setup (for business owners)
- Payment information for subscription billing (processed securely by third-party providers)

- SMS message content when you text a LeadTap-powered phone number
- Chat widget interactions on business websites
- Timestamps of conversations and lead capture events
- IP address and browser type when accessing our web properties
Information from Third Parties
- Phone carrier information associated with inbound calls and texts
- Business profile information from GoHighLevel (our CRM platform partner)
2. How We Use Your Information
We use the information we collect to:
- Deliver automated SMS responses and lead capture services on behalf of local businesses
- Connect customers with business owners through our AI-powered conversation system
- Send appointment reminders, booking confirmations, and service updates
- Send promotional messages when you have provided explicit consent
- Maintain and improve our platform and services
- Comply with legal obligations and carrier requirements
- Prevent fraud and ensure platform security
We do not use your information for purposes other than those described above without your explicit consent.
3. SMS Messaging & Consent
How You Opt In
By texting a LeadTap-powered phone number or submitting your phone number through a LeadTap chat widget, you consent to receive SMS messages from that business. These messages may include:
- Responses to your service inquiries (transactional)
- Appointment reminders and booking confirmations (transactional)
- Promotional offers, seasonal campaigns, and re-engagement messages (marketing) — only when separately consented
Message Frequency
Message frequency varies based on your interactions with the business. You may receive between 1 and 10 messages per month depending on your activity and consent level.

Message and data rates may apply. Contact your wireless carrier for details about your plan.
How to Opt Out
You may opt out of SMS messages at any time by replying STOP to any message. You will receive one confirmation message and then no further messages will be sent. To re-subscribe, reply START.

Consent is Not a Condition of Purchase
Consent to receive SMS messages is never a condition of purchasing any goods or services.
4. Information Sharing
We do not sell, rent, or share your personal information with third parties for their own marketing purposes. We may share information in the following limited circumstances:
- With the business you contacted: Your name, phone number, and inquiry details are shared with the business owner whose LeadTap system you interacted with
- With service providers: We use GoHighLevel (CRM), LeadConnector (mobile app), and Twilio/LC Phone (SMS delivery) to operate our platform. These providers have their own privacy policies.
- For legal compliance: We may disclose information when required by law or to protect our legal rights
- In a business transfer: If LeadTap is acquired or merged, your information may be transferred as part of that transaction
We do not share SMS opt-in consent data with any third parties for marketing purposes.
5. Data Retention
We retain personal information for as long as necessary to provide our services and comply with legal obligations. Specifically:
- Customer lead and conversation data is retained for the duration of the business's active subscription plus 90 days
- SMS opt-out records are retained indefinitely to honor unsubscribe requests
- Business account data is retained for 7 years for financial and legal compliance

6. Your Rights
Depending on your location, you may have the following rights regarding your personal information:
- Access: Request a copy of the personal information we hold about you

- Portability: Request your data in a portable format

Terms of Service
These Terms of Service ("Terms") govern your use of LeadTap's AI-powered lead capture platform and related services. By subscribing to or using LeadTap, you agree to these Terms. If you do not agree, do not use our services.
LeadTap is operated by William Hurd, doing business as LeadTap, located at 5808 Oaklawn Avenue, Edina, MN 55424.
8. Acceptable Use of Service
LeadTap provides AI-powered SMS lead capture, missed call text-back, chat widget, and marketing automation services for local businesses. You agree to use the Service only for lawful business purposes and in compliance with all applicable laws, including:
- The Telephone Consumer Protection Act (TCPA)
- CAN-SPAM Act
- A2P 10DLC carrier requirements
- All applicable state and local laws
You may not use LeadTap to send unsolicited messages, spam, or any content that is illegal, harassing, or violates carrier guidelines. Violation of these terms may result in immediate termination of your account.
9. Accounts & Sub-Accounts
Business owners who subscribe to LeadTap receive a sub-account within the LeadTap platform. You are responsible for:
- Maintaining the security of your account credentials
- All activity that occurs under your account
- Ensuring your use of the Service complies with these Terms
- Obtaining proper consent from your customers before sending them SMS messages
LeadTap reserves the right to suspend or terminate accounts that violate these Terms or applicable laws.
10. Payment Terms
- Subscription fees are billed monthly in advance
- Setup fees are one-time and non-refundable once onboarding has begun
- Cancellation: You may cancel your subscription at any time. Your service will continue through the end of your current billing period. No partial refunds are issued.
- Price changes: LeadTap may adjust subscription pricing with 30 days written notice. Your Year 1 rate is locked for 12 months from your start date.
- Failed payments: If payment fails, we will attempt to retry for 5 days. After that, your account may be suspended until payment is received.
11. Termination
Either party may terminate the service relationship at any time:
- By you: Cancel anytime by notifying LeadTap in writing. No long-term contract required.
- By LeadTap: We may terminate your account immediately if you violate these Terms, engage in illegal activity, or abuse our platform.
Upon termination, your access to the LeadTap platform will end. You may request an export of your contact data within 30 days of termination.
12. Limitation of Liability
LeadTap provides its services "as is" without warranties of any kind. To the maximum extent permitted by law:
- LeadTap is not liable for any indirect, incidental, or consequential damages arising from your use of the Service
- Our total liability for any claim shall not exceed the amount you paid to LeadTap in the three months preceding the claim
- LeadTap is not responsible for SMS delivery failures caused by carrier filtering, network issues, or recipient opt-outs
- LeadTap does not guarantee specific business results, lead volumes, or revenue outcomes
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above limitations may not apply to you.
